WHAT IS THE DIVORCE PROCESS IN DUPAGE COUNTY?
Eighteenth Judicial Circuit Court of DuPage County
Do I have to wait for a court date and go to court?
No. Prove-up, or the final court date for a divorce in which a judge confirms that all legal requirements have been met, can be done via affidavit, meaning that divorcing spouses never actually have to go to court. However, note that the judge does have the right to require an in-person court appearance.
Do I have to take a parenting class?
In Illinois, divorcing parents with minor children are required to take a parenting education class. In DuPage County, the parenting class can be taken at any time. If divorcing parents would like their parenting class certificate filed with their court case, they should contact the court clerk, who will pull the certificate and file it electronically for them.
Parents can register for the parenting class here. In DuPage County, the parenting class costs $100 each.
What are the court costs associated with filing for divorce?
For both a Dissolution with Children (DC) and a Dissolution without Children (DN), court costs are $348. Court Appearance costs are $223. The parenting class costs $100 each.
